3. Eligibility
You must be at least 16 years of age to use the Platform independently. Users under the age of 16 may only use the Platform with the verified consent of a parent or legal guardian. By using the Platform, you represent and warrant that you meet the applicable eligibility requirements and that all information you provide is accurate and complete.
4. Account Registration and Security
4.1 Registration
Certain features of the Platform require you to create an Account. You agree to provide accurate, current, and complete information during registration and to keep your Account information updated at all times.
4.2 Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us immediately at contact@xekytoe.com if you suspect any unauthorised access to or use of your Account.
4.3 Account Restrictions
You may not share your Account credentials with any third party. Each Account is for individual use only unless expressly authorised otherwise by xekytoe. We reserve the right to suspend or terminate Accounts that we reasonably believe are being shared or misused.
5. Permitted Use
You may use the Platform only for lawful purposes and in accordance with these Terms of Use. You agree not to:
- Use the Platform in any way that violates applicable laws or regulations.
- Copy, reproduce, distribute, or commercially exploit any Content without prior written authorisation.
- Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
- Upload or transmit any harmful, offensive, or disruptive content.
- Engage in any activity that could impair or overburden the Platform's infrastructure.
- Use automated tools, bots, or scrapers to access or extract data from the Platform.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Interfere with other Users' access to or enjoyment of the Platform.
6. Intellectual Property
6.1 Platform Content
All Content on the Platform, including but not limited to course materials, videos, graphics, text, and software, is the property of xekytoe or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership rights over Platform Content.
6.2 Limited Licence
xekytoe grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal, non-commercial educational purposes. This licence does not permit resale, sublicensing, or redistribution of any Content.
6.3 User-Submitted Content
If you submit, upload, or share any content through the Platform, you grant xekytoe a worldwide, royalty-free, non-exclusive licence to use, display, and process that content solely for the purpose of providing and improving the Services. You retain ownership of your submitted content and represent that you have all necessary rights to grant this licence.
7. Payments and Refunds
7.1 Fees
Access to certain Services may require payment of fees. All applicable fees will be clearly communicated before purchase. Prices are displayed in the currency applicable to your region and may include applicable taxes.
7.2 Payment Processing
Payments are processed through third-party payment providers. xekytoe does not store your full payment card details. By submitting a payment, you agree to the terms of the relevant payment processor.
7.3 Refund Policy
Refund eligibility depends on the specific Service purchased. Refund conditions will be stated at the point of purchase. Unless otherwise specified, fees paid for completed sessions or downloaded materials are non-refundable. Requests for refunds should be directed to contact@xekytoe.com.
8. Sessions and Scheduling
Where the Platform provides live or scheduled sessions, the following conditions apply:
- Session availability is subject to instructor scheduling and may change.
- Users are responsible for attending sessions at the scheduled time. Missed sessions may not be rescheduled without prior arrangement.
- xekytoe reserves the right to cancel or reschedule sessions due to unforeseen circumstances and will endeavour to provide reasonable notice.
- Recorded sessions, where available, are provided for personal review only and may not be shared or republished.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. We encourage you to review the Privacy Policy regularly.
10. Third-Party Links and Services
The Platform may contain links to third-party websites or integrate third-party tools. These are provided for convenience only. xekytoe does not endorse, control, or assume responsibility for any third-party content, services, or privacy practices. Your interactions with third-party services are governed by their own terms and policies.
11. Disclaimers
The Platform and all Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. xekytoe does not warrant that:
- The Platform will be uninterrupted, error-free, or free from harmful components.
- Any Content is accurate, complete, or suitable for any particular purpose.
- Results obtained from using the Platform will meet your expectations or requirements.
Educational outcomes depend on individual effort, engagement, and circumstances beyond our control. xekytoe does not guarantee any specific learning result.
12. Limitation of Liability
To the fullest extent permitted by applicable law, xekytoe and its officers, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform or Services. This includes, without limitation, loss of data, loss of revenue, or loss of opportunity, even if xekytoe has been advised of the possibility of such damages.
In no event shall xekytoe's total cumulative liability to you exceed the amount paid by you to xekytoe in the twelve months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless xekytoe, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
xekytoe reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms of Use or engage in conduct that we determine to be harmful to the Platform, other Users, or xekytoe. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply.

15. Modifications to the Platform and Terms
xekytoe reserves the right to modify, suspend, or discontinue any part of the Platform or Services at any time without prior notice. We also reserve the right to update these Terms of Use at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
16. Governing Principles
These Terms of Use are intended to be interpreted in a manner consistent with fair dealing and good faith. Any dispute arising in connection with these Terms should first be addressed through direct communication with xekytoe at contact@xekytoe.com. We will endeavour to resolve disputes in a reasonable and timely manner.
17. Severability
If any provision of these Terms of Use is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms of Use, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and xekytoe regarding your use of the Platform and supersede all prior agreements, representations, or understandings.
